Intsell Free-Use Terms

1. Parties, Acceptance, and Scope

These Terms form an agreement between Yılmaz Kok, the provider of Intsell ("Intsell"), and the person creating an account for a store or the business that person represents (the "User" or "Store"). They become binding when the current version is accepted during signup. Questions may be sent to info@intsell.app.

The User represents that they are authorized to act for the Store and authorize store personnel. Mandatory consumer and data-protection rights remain unaffected.

2. The Service

Intsell is software that enables store staff to create personalized selections containing product images, prices, product information, and the Store's contact channel and to share them by QR code or link.

Intsell is not a payment institution, marketplace, order-acceptance system, or ecommerce checkout. Product sales, price commitments, stock, delivery, returns, warranties, and the customer sales relationship remain the Store's responsibility.

3. Accounts, Authorization, and Security

The User must provide accurate, current business information, protect credentials, invite only authorized personnel, and promptly revoke access when a person's authority ends. Accounts are personal and may not be transferred.

Suspected unauthorized access, account compromise, or a security incident must be reported promptly to info@intsell.app. To protect the account, Intsell may terminate sessions, require a password reset, or temporarily restrict access.

4. Free Publication Allowance

Each new Store receives a lifetime allowance of 30 unique selection publications. One allowance unit is consumed only when a draft is first published as a unique selection and QR code. Creating drafts, previewing, scanning a QR code, and updating the same published selection do not consume another unit.

Once the allowance is exhausted, new publication is blocked without deleting existing drafts or affecting selections during their ordinary validity period. No card or payment details are required. The free service creates no paid plan, automatic renewal, or purchase commitment.

5. Store Content and Intellectual Property

The Store represents that it has the rights required for product images, logos, brand assets, prices, descriptions, and other uploaded content and that the content is accurate, current, and lawful.

The Store grants Intsell a non-exclusive, purpose-limited license for the service period to host, technically reproduce, transform, and display the content in selections. Ownership remains with the Store or the relevant rights holder.

6. Personal Data

Platform-user data is processed under the Privacy Notice for Platform Users. If the Store enters an optional customer name or note, the Store is the controller and is responsible for providing required information, identifying a legal basis, and responding to data-subject requests.

Intsell processes the customer name or note as processor under the Data Processing Addendum. Special-category data, health data, identity numbers, payment-card data, and unnecessary contact details must not be entered into free-text fields.

7. Availability and Changes

Intsell uses reasonable technical and organizational efforts to keep the service secure and available. The free service is not warranted to be uninterrupted, error-free, or suitable for a particular commercial outcome. Maintenance, security events, infrastructure failures, or force majeure may cause temporary interruptions.

Material changes affecting the essential nature of the service or User rights are communicated within a reasonable period. Changes requiring renewed contractual acceptance are presented separately for acceptance.

8. Suspension and Termination

Intsell may proportionately restrict content or suspend an account temporarily or permanently for unlawful use, a security risk, infringement of third-party rights, abuse of the free allowance, or a material breach. Where practicable, the reason and a remediation opportunity are provided.

The User may request account closure at info@intsell.app. Except for legally required records and dispute evidence, account content is deleted under the Retention and Account Deletion Policy after identity and authority are verified.

9. Limitation of Responsibility

Intsell is not responsible for the Store's products, prices, inventory, customer communications, or sales transactions. Neither party is responsible for delay caused by an event outside its reasonable control that it could not reasonably prevent.

To the extent permitted by mandatory law, Intsell is responsible for indirect loss, loss of profit, or data loss arising from the free service only to the extent caused by its wilful misconduct or gross negligence. Nothing excludes liability that cannot lawfully be limited.

10. Governing Law and Entire Agreement

These Terms are governed by the laws of the Republic of Turkey, subject to mandatory jurisdiction rules. If any provision is invalid, the remaining provisions continue in effect. The Data Processing Addendum and Acceptable Use Rules form part of these Terms.
